1. Acceptance of these Terms
By accessing or using shfunding.com (the “Website”), you agree to these Website Terms. If you do not agree, do not use the Website or submit information through its forms.
You must be at least 18 years old and legally able to provide the information you submit.
2. Business-purpose lending scope
Safe Harbor Funding LLC (“SHF,” “we,” “us,” or “our”) provides business-purpose financing secured by non-owner-occupied real estate. The Website is not an offer of consumer-purpose credit and is not intended for owner-occupied residential financing.
Loan programs, guidelines, ranges, examples, timing estimates, and other information on the Website are general and may be changed or withdrawn without notice.
3. No application, approval, or commitment to lend
Submitting a website form does not constitute a complete loan application, loan approval, binding term sheet, commitment to lend, reservation of funds, guaranteed rate or terms, or guaranteed closing date.
Preliminary feedback or proposed terms may change after property review, title review, verification, due diligence, receipt of additional information, or changes in the transaction. SHF is legally committed only by a final written agreement signed by an authorized SHF representative.
4. Information submitted through the Website
By submitting information, you represent that it is accurate to the best of your knowledge, that you are authorized to provide it, and that SHF may contact you and other authorized transaction parties as reasonably necessary to evaluate and respond to the inquiry.
Brokers who submit borrower or transaction information represent that they have permission to provide the information and to introduce the proposed transaction to SHF.
5. Property evaluation, appraisal statements, and costs
Any property evaluation performed by SHF is solely for SHF’s underwriting and lending decision. It is not a traditional appraisal prepared for or on behalf of the borrower, a guarantee of property value or condition, or a substitute for an inspection, engineering review, environmental review, construction review, legal advice, tax advice, accounting advice, or investment advice.
Statements that SHF does not charge a traditional third-party appraisal fee or a separate underwriting fee do not mean that a transaction has no costs. Borrowers may remain responsible for disclosed origination charges and ordinary third-party closing costs, including legal, title, recording, insurance, environmental, survey, municipal, or other transaction-specific expenses.
6. Broker Partners
Submitting a broker registration or deal does not create an agency, fiduciary, exclusivity, referral-fee, borrower-protection, or compensation agreement. Any broker compensation or relationship protection must be established separately in writing on a transaction-by-transaction basis and is payable only in accordance with that agreement, generally upon a completed closing.
Brokers are responsible for maintaining any license, registration, authority, disclosure, or consent required for the applicable state, transaction, and services performed. SHF may communicate directly with a borrower and other transaction parties for underwriting, documentation, closing, servicing, and administration while keeping the broker involved as appropriate.
7. Website ownership and permitted use
The Website, including its copy, logos, graphics, design, and branding, is owned by or licensed to SHF and is protected by applicable intellectual-property laws. You may view and print limited content for your own legitimate evaluation of SHF’s services. You may not reproduce, republish, distribute, scrape, commercially exploit, or create derivative works from Website content without written permission.
You may not probe, scan, hack, disrupt, overload, introduce malicious code, submit spam or false information, interfere with Website operation, or use automated systems to extract content or data except as authorized in writing.
8. Third-party links and future portals
The Website may contain links to unaffiliated websites, secure borrower portals, servicing platforms, or other third-party services. Those services are subject to their own terms and privacy policies. SHF does not control and is not responsible for the availability, content, security, or practices of an unaffiliated third-party service.
9. No professional advice
Website information is general and does not constitute legal, tax, accounting, construction, engineering, environmental, investment, or other professional advice. Users should consult their own qualified professionals concerning a property or transaction.
10. Disclaimers and limitation of liability
The Website is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, SHF disclaims warranties concerning Website accuracy, completeness, availability, security, or fitness for a particular purpose.
To the fullest extent permitted by law, SHF will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the Website, reliance on general Website information, transmission errors, service interruptions, or third-party websites or services. Nothing in these Terms limits liability that cannot lawfully be limited.
11. Governing law and venue
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules. Any legal action arising out of or relating to the Website or these Terms shall be brought exclusively in the state or federal courts located in Massachusetts, with venue in Essex County where applicable, and each user consents to the jurisdiction of those courts.
12. Changes and severability
We may update these Terms by posting a revised version on the Website. The effective date shown at the top identifies the current version. If any provision is held unenforceable, the remaining provisions will continue in effect.
